General terms

This page contains BURGA (UAB Hautica) terms and conditions. We strongly recommend reading this before ordering any products, because if you purchase from us, it means that you have agreed upon these terms and conditions. The version of the terms and conditions in force at the time the order is placed shall apply to the specific order.

By ordering from BURGA, you confirm that you are at least 18 years old (or have parents or legal guardians’ permission to do it) and accept these terms and conditions.

If you do not agree with the terms, you should not use BURGA website or purchase the items. For the sake of clarity, it should be noted that it is not possible for you to accept these terms and conditions in part, unless otherwise agreed in writing between you and BURGA.

We assume no risk or liability and shall be exempt from all liability if you have not read these terms and conditions in whole or in part, even if allowed to do so.

 

Personal Information

As stated in our Privacy Policy, all the information you provide us with or we obtain in other ways is collected to ensure a smooth ordering and delivery process.

 

Payment

Until payment is made, all the products remain the property of BURGA. We leave ourselves the right not to send the items if the payment has been rejected or there have been any other issues regarding it.

The price we apply to your order is the one that was set on the day the purchase was made. Shipping expenses are shown before the confirmation of the purchase. Your credit card information is not stored, so the entire payment process is completely safe & secure.

Delivery

Please note that customs/import fees are not included in our services. These fees are the responsibility of the recipient and are imposed in accordance with the regulations of the country to which the goods are being shipped.

We are a customer-first company, and we strive to provide the best quality products with a seamless experience for you. Still, sometimes things happen, so if there's anything wrong with the item you have received, we will do our best to fix it and be satisfied.

 

Legal right of cancellation

You may cancel your order by contacting us at hello@burga.com

Depending on where you live, you have a legal right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCRs") or equivalent consumer legislation in the EU. This means that, during a certain cancellation period, if you change your mind or for any other reason you decide you do not want to keep the purchased products, you can notify us of your decision to cancel the order. If you have already received your order, you will need to return the items you wish to cancel to us. Please consider that all the shipping expenses for returning the item of good quality remain the responsibility of the customer.

If the order has been placed from a country outside EU, additional fees such as customs or taxes may need to be paid for the return and you are responsible for paying such additional costs.

WARNING: Personalized products are one of a kind and has been manufactured only for you. Therefore we can not exchange or refund any customized products under any circumstances unless the product has a manufacturer's defect.

Returned items must not have been worn or used and must be in their original condition, they will be inspected once received.

Returned items must keep the labels but the return packaging does not need to be the shipping one. However, it is your responsibility to ensure that returned items are properly packed so as not to be damaged during the return journey. In the event that a returned item arrives in inadequate conditions, we will return the item to you. In this case, we will not be able to proceed with the refund. Refunds for returned items will be issued to the original payment method you used when placing an order.

If we do not receive your cancelled order, we may arrange a recovery at your expense.

If we notice an unusual pattern of returns activity: e.g. we suspect someone is actually using their purchases and then returning them, ordering and returning excessive amounts of items or the items returned don't match what you ordered - then we might have to deactivate the account and any associated accounts.

 

Returns and refunds

If the items do not comply with the quality requirements or you have received wrong items, you shall have a right, in accordance with the procedure provided for by law, that the items should be replaced to the correct quality or you have a right for refund.

If you want to return the defective or wrong item, please contact us within 30 days of receiving the order at hello@burga.com. If you have discovered our fault, please take pictures of the defective, or wrong case sent to you and attach them to the initial email with an explanation.

We do not issue refunds if you do not provide a reason for returning the item or send it back without contacting us first.

Refunds for returned items will be issued to the original payment method you used when placing your order.

BURGA will cover all the shipping expenses for returning the defective or wrong item.

We are pleased to announce that we have an exception for one of our product categories - Eyewear. Choosing the right pair of glasses can be tricky. That's why we offer free returns for all of our eyewear products.
If you're not thrilled with your new frames—don't panic. Simply contact our customer support team within 30 days of receiving your BURGA eyewear.
They'll supply you with a returns slip and instructions for sending back the product. Free of charge!
We want you to find the perfect pair for your unique face. So, feel free to explore our eyewear line, knowing you can return them easily if needed.

The returned product must not be used and should be sent to us in its original packaging.

Please write “RETURNED ITEM” on the packaging so that certain misunderstandings can be avoided.

Your BURGA account

You, as a customer, are responsible for the information that you are providing on our website.

A customer must not use the account unlawfully or rudely or in other ways that may cause harm to BURGA.

We leave ourselves the right to remove or suspend your account if we notice any signs of suspicious activity. Using someone else’s BURGA account without their permission is strictly prohibited.

 

Warranty

We undertake to sell you items of excellent quality.

The items are guaranteed for terms provided by applicable law.

Our guarantee of quality does not limit or restrict your rights under applicable law in the event of the purchase of defective items.

BURGA offers you a warranty of a certain period on all items sold on our website. The warranty covers manufacturing defects. However, please note that the warranty does not cover failures or other defects in the items that are not caused by the fault of us or the manufacturer of the items. No warranty shall apply where the defect or damage to the items is due to negligence or carelessness, external influences, natural wear and tear, use and care not in accordance with normal practice.

Please note that the warranty will only apply if you’ve followed the instructions in our use- or care guide for the specific product.

 

Product Safety

All products sold by BURGA are designed and manufactured to meet the safety standards required by applicable EU legislation, including Regulation (EU) 2023/988 (General Product Safety Regulation).

BURGA takes all reasonable measures to ensure that products listed on its website meet applicable EU safety standards. We continuously monitor for any potentially dangerous products and reserve the right to remove such listings promptly in accordance with Regulation (EU) 2023/988.

For any safety-related inquiries, potential risks, or urgent issues concerning products purchased through BURGA’s website, you may reach out directly via email quality@burga.com. Our dedicated team will respond promptly to address and resolve any safety-related matters.

In the event of a product safety recall or where essential safety information must be conveyed for the secure use of a product, BURGA will notify you directly and without undue delay. Using contact information collected during transactions, BURGA will issue recall notices or safety warnings to ensure that you receive timely information regarding any product safety risks.

If it is not possible to directly contact all affected consumers regarding a product safety recall or safety warning, BURGA will take all reasonable steps to disseminate clear and visible notices through appropriate channels to ensure the widest possible reach. These channels may include, but are not limited to, BURGA’s website, social media platforms, email newsletters, and announcements in mass media.

In the event of a product safety recall, BURGA will provide you with remedies to address the issue promptly and effectively. You will be offered a choice between at least two of the following options: (a) the repair of the recalled product; (b) a replacement of the recalled product with a safe product of the same type and at least the same value and quality; or (c) an adequate refund of the value of the recalled product, with the refund amount being at least equal to the original price paid by you.

By way of exception, BURGA may offer only one of these remedies if providing additional remedies is impossible or if doing so would impose disproportionate costs, considering all relevant circumstances, including whether the alternative remedy could be provided without significant inconvenience to the consumer.

 

Use of the Website

We forbid you to use this website for any of the following purposes:

  • Breaching any laws or uploading unlawful, vulgar, or abusive material
  • Interfering with others’ use or enjoyment of this website in a negative way
  • Copying designs or other content that is BURGA’s intellectual property
  • Using content uploaded by other customers without their permission

You must not misuse or tamper with the website, i.e. hack, introduce viruses trojans worms, logic bombs or other technologically harmful material or carry out denial of service attacks, etc., or otherwise mess with BURGA’s tech or functionality, or steal BURGA’s customer’s data.

You are also prohibited from using automated systems or software to extract data from our website.

You will be responsible for BURGA’s losses if you breach these provisions. You also agree to indemnify, defend, and hold harmless BURGA, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this website or your breach of these terms.

We do not warrant and shall not be liable if the website is unavailable at any time. You acknowledge that BURGA is not responsible for the internet access services.

 

Reviews on Our Website

If you have purchased the items on the website and meet the other requirements set out in this section of the terms, you shall have the right to evaluate the purchased items by leaving a review on the website.

We take no responsibility for the content you or other buyers submit, post or display on or via BURGA’s website.

We undertake to comply with the requirements of the applicable law, these terms and the Privacy Policy when collecting and publishing your review.

 

Changes

We reserve the right to change, amend or supplement these terms and conditions at any time.

Unless otherwise provided, you shall be informed of any changes to the terms and conditions in the website and the changes to the terms and conditions shall become effective immediately upon their publication in the website. If you do not agree to the new terms and conditions, you should no longer use the website and should not purchase the items.

 

Advertising and Sponsorship

This website may contain advertising or sponsorship material . You understand and agree that BURGA will not accept any responsibility for the content of third parties (hereinafter referred to as the “Content").

We make no warranties or representations whatsoever with respect to the Content (including, without limitation, no warranty as to the accuracy of such content, and no liability for the quality of the products or services contained in the Content). You understand that any information that can be accessed through hyperlinks to other websites is the sole responsibility of the third party who provided that Content.

 

Limitation of liability

We are not liable for any loss or damage caused by your use of the purchased items if the use of the product does not comply with what is set out in any applicable user guidelines and care guide and/or if the items are not handled with proper care. You are responsible for examining the items to make sure that it is not defective prior to the use of the product.

Our liability for any loss or damage arising in connection with your order on our website is limited to the value of your order, unless otherwise stipulated by mandatory law. We shall under no circumstances be liable for indirect losses or indirect damage.

 

Intellectual Property Rights

All content of the website, including all texts, graphics, images, photographs, any footage or visual material/recordings, trademarks, logos, other visual signs, illustrations, graphic design of the website, software code and/or individual parts of all of the above-mentioned objects, domains, etc. (hereinafter referred to as the "BURGA’s Content"), is our or the third party’s intellectual property, which is protected by the laws and the international legal acts regulating the copyrights and the rights of intellectual property.

By accepting these terms, you understand that by using the website and purchasing the items, you do not acquire any rights to the BURGA’s Content and may only use the BURGA’s Content in accordance with these terms. You shall not use the BURGA’s Content, including but not limited to, publishing, selling, renting, copying, displaying, modifying, adapting, reproducing, and using it in any way other than solely for personal and informational purposes without the consent of the BURGA or the third party holding the relevant intellectual property rights.

If you infringe on our intellectual property rights, you shall be liable to compensate for damages resulting from such infringement.

Notifications relating to the execution of the order shall be sent to the e-mail and/or telephone number indicated by you. BURGA shall not be liable if you do not receive the sent information or confirmation messages due to internet connection, network disruptions of the email service providers, messages sent to the SPAM directory or incorrect data that you provided to us.

 

Dispute settlement and applicable law

These terms and the purchase of the items shall be governed by the law of the Republic of Lithuania. Any disputes arising out of these terms or the sale of the items shall be settled and referred to the competent courts of the Republic of Lithuania. Please note that we can issue legal action in the territory where the buyer has a permanent residence.

If you have a complaint, you can outline and submit it to us at the contacts specified in these terms. We undertake to respond to such claims within 14 (fourteen) calendar days from the date of receipt of the request.

 If we cannot resolve the dispute, you can submit a complaint to: State Consumer Rights Protection Authority of the Republic of Lithuania; under EU dispute settlement; or directly to a competent court.
