Terms and Conditions

Eligibility:

1. BURGA Lucky Ticket Giveaway (hereinafter referred to as "Giveaway") is open to Customers that placed an order during our 2024 Black Friday Sale.
2. Participants must be at least 18 years old or the legal age of majority in their jurisdiction of residence, whichever is higher.
3. Employees, contractors, and immediate family members of BURGA, its affiliates, subsidiaries, advertising and promotional agencies, and anyone connected with the Giveaway's production, distribution, or implementation are not eligible to participate.

 

Giveaway Period:

1. The Giveaway will start at 18:00 (GMT+2) on November 18, 2024, and will conclude at 10:00 (GMT+2) on December 3, 2024 ("Giveaway Period").

 

How to Enter:

1. To enter the Giveaway, Participants must complete an order on our official website during the Giveaway Period.
2. A limited number of Giveaway Tickets will be randomly placed in selected parcels of orders completed during the Giveaway Period.
3. If you received one of our Giveaway Tickets with your parcel, scratch off the opaque covering to reveal your winning.

 

Prize:

1. Prizes are determined by scratching off the opaque covering on the Ticket.
2. The number of available prizes is limited and includes the following: 919 discount codes for 15% OFF, 50 Tough Phone Cases, 20 Travel Mugs (500 ml), 10 Product Bundles (each containing 1 Phone Case, 1 Earbuds Case, 1 Notebook, 1 Travel Mug, and 1 StickPad) (hereinafter referred to as "Prize"), and 1 iPhone 16 (hereinafter referred to as "Main Prize").
3. Each Giveaway winner will be entitled to receive one Prize specified on the corresponding winning Ticket.
4. The winner of the Main Prize will receive a brand new iPhone 16.

 

Prize Claim:

1. To claim your Prize, you must contact us at community@burga.com and provide a clear photograph of your Lucky Ticket with the serial number visibly displayed. Prizes will not be awarded without valid photographic proof, or if the serial number is not visible, inaccurate, or otherwise unverifiable.
2. To claim the Main Prize, you must upload a video or photo of your Golden Ticket to your Instagram or TikTok account, ensuring the serial number is not visible, and tag us @burgaofficial. Additionally, contact us at community@burga.com with a link to your post and a photograph of your Golden Ticket with the serial number visibly displayed. The Main Prize will not be awarded without a public post, valid photographic proof, or if the serial number is not visible, inaccurate, or otherwise unverifiable.
3. All winners must claim their prizes by contacting us no later than January 31, 2025. Failure to do so will result in forfeiture of the Prize/Main Prize.
4. The Prize will be dispatched to the Winner within one month of the Winner contacting us and confirming delivery details. The Winner is solely responsible for providing accurate, complete, and up-to-date delivery information.
5. The Main Prize will be dispatched to the Winner within three months of the Winner contacting us and confirming delivery details. The Winner is solely responsible for providing accurate, complete, and up-to-date delivery information.
6. Prizes will only be shipped to destinations within the countries serviced by BURGA's delivery network.

 

Prize Disclaimer:

1. All prizes (including the Main Prize) are awarded "AS IS" and without warranty from BURGA of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
2. The Prize/Main Prize will be awarded if properly claimed. No substitution, cash redemption, or transfer of the right to receive any Prize or Prize component is permitted except at the discretion of BURGA.
3. Discount codes are valid from December 4, 2024, through January 31, 2025. These codes are non-cumulative and cannot be combined with any other discount codes or promotional offers, except for the "Buy 4, Pay for 2".
4. BURGA reserves the right to substitute a Prize or Prize component of equal or greater value.
5. Winners are not permitted to request to change any Prize or Prize component with any other product.
6. The Prize consists only of the items expressly specified on the Ticket and in these Terms and Conditions.
7. All expenses or costs associated with the acceptance or use of any Prize or any component thereof that are not expressly specified in these Terms and Conditions as being part of the Prize are the responsibility of the winner.
8. In no event will BURGA award more than one (1) Main Prize.
9. BURGA reserves the right to select the color of the Main Prize at its discretion, and no warranties for Main Prize are provided. If any defects are found, the Winner should reach out to the authorized Apple service for assistance.

 

Grant of Rights: 

1. By claiming the Main Prize, the participant acknowledges that their name, handle, and any content included in their entry may be posted across any or all of BURGA's digital and social assets at BURGA's sole discretion.

 

Release and Limitation of Liability: 

1. BURGA and its parent companies, affiliates, subsidiaries, agents, and licensees, and the officers, directors, owners, shareholders, employees, representatives, and agents of each of the foregoing are not responsible, and will have no liability for; (a) late, lost, delayed, illegible, damaged, corrupted, or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information, or any other human or technical errors of any kind relating to the operation of the Giveaway, the communications or attempted communications with any participant, the submission, collection, storage, or processing of entries, or the administration of the Giveaway, (b) any Force Majeure Event or any other event outside their control that may cause any alteration, postponement, or cancellation of any part of the Giveaway or any prize; (c) undeliverable e-mails or entries resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in a user's e-mail account to receive e-mail, or (d) any damage to any computer system or mobile device resulting from participation in or accessing or downloading information in connection with this Giveaway. 
2. Released parties shall have no liability for any personal injury, death, property damage, or other damage or expense resulting from or arising out of any component of any prize or any other aspect of any Prize winner's use or misuse of the Prize. 
3. By entering, each participant fully releases, covenants not to sue, and agrees to hold each of the Released Parties harmless from and against any and all claims and liability arising out of the operation of the Giveaway, participation in the Giveaway, the use of the BURGA Giveaway application and website, the acceptance, receipt or use (or misuse) of any Prize or Prize component, and/or any use of the participant's name, likeness, voice, and/or biographical information as permitted hereunder, including without limitation all claims and liabilities based on any personal injury, property damages, loss, and/or death. 
4. Participants assume all liability for any injury or damage caused or claimed to be caused by participation in this Giveaway, the use of the BURGA Giveaway application and website, or the acceptance, receipt, or use of any prize or prize component. 
5. The Released Parties are not responsible for any typographical, printing, production, or other error in the administration of the Giveaway or the announcement of any prize or notification of any winner. 
6. The winner agrees to execute such additional release(s), waiver(s) of liability, and agreement(s) as may be required by a provider of a Prize component within the period specified by BURGA.

 

General Terms:

1. By participating in the Giveaway, Participants agree to abide by these Terms and Conditions.
2. BURGA reserves the right to disqualify any Participant who violates these Terms and Conditions or engages in any fraudulent or inappropriate conduct.
3. BURGA reserves the right to cancel, suspend, or modify the Giveaway in the event of unforeseen circumstances or technical issues that affect the fairness or integrity of the Giveaway at its sole discretion.
4. All decisions regarding the Giveaway, including winner selection, are final and binding.
5. Participants are responsible for any taxes or customs duties associated with the Prize and its delivery.
6. Any personal information collected from Participants will be used solely for the purpose of administering the Giveaway and will be handled in accordance with BURGA's Privacy Policy.
7. Participation in the Giveaway is voluntary and cannot be treated as coercion.
